Privacy statements are often long and confusing. At PitchIn, we try to keep ours as short, clear and simple as possible.

 

When you visit PitchIn, a lot of data is exchanged between us. The PitchIn team believes that you should be in control of your data. We try to handle your data as sparingly and confidentially as possible, but we’re not perfect at it yet and are still working on it. That is why we’re constantly adapting our technologies, processes and this privacy policy. Certain services require cooperation with other companies. We will only share your data if you have given us permission to do so. You can find the details and more below.

The goal of PitchIn is to connect people to improve their quality of life and to be a global platform that enables individuals to do more of what they love and create real communities.

 

In order to continuously improve our services, we learn through you and your actions on PitchIn. Accordingly, if you choose to use PitchIn, you agree to share some information with us.

 

How PitchIn collects information

We collect information about you when you use PitchIn. For example, if you often search for communities with certain interests, or even join some, we may assume that you share those passions.

 

We also collect information when you create a PitchIn account. This information includes your email address, the name you wish to be contacted by and your date of birth. You can find the details in the privacy policy.

 

Sometimes, we receive information about you from other users and services. For example, if someone shares their device contact list with PitchIn and your mobile number is also included, this would be the case.

 

Sharing information

You usually tell us to share your information when we do this. You therefore retain control over who your information is shared with.

We share information with services that are necessary to provide our services or if we think it is required by law.

 

Control over your information

You can edit some of your information yourself directly through the application in the settings or in your own profile. To do this, simply click on the field you wish to edit. What PitchIn does

PitchIn is all about connecting and networking with people. Through this, PitchIn wants to be able to offer you a better-quality life. Social media was created to connect people but social media has been used more and more to keep us on screen for as long as possible, distracting us more and more from what's important in real life and often distancing us from fellow human beings and life on the doorstep. We want to use social media again as a means to come together. The meaning of "pitch in" therefore reflects our goal. We want to create a society that helps each other with any questions, tasks and activities and helps to connect people with concerns with others who might be able to help.

 

A. Your data

In order to provide and improve our services, we need to know some information about you. When you register with PitchIn, we receive information such as your username, nickname, email address, password, mobile number, city and date of birth. To make it easier for other PitchIn users to find you, we also need your surname and first name and may ask for other information that will be publicly visible on our platform, such as a profile picture, personal description, interests or skills. We need this information to better tailor our services to you and to identify you along with your IP address or user behaviour. For certain other services, we need your credit card or bankdetails and associated information or your location. All information relating to you is hereinafter referred to as "your information".

 

You also provide us with the information that you share and send via our platform or that you provide to us via support or in any other form when contacting us.

 

The same common sense about sharing personal information online applies to PitchIn. Please be aware that other users of PitchIn may store your posts that you share through our platform and may also copy them from the application.

 

Also be aware that the sum of your data will give a good picture of you as a person. Please also note that if you sign up via Google, Facebook or other services or if you share information with third parties (e.g. via Snapchat), certain information about you will also be shared with these companies.

 

We use cookies to easily recognise you when you visit us and to optimise our services. We process and store your comments and reactions in the individual forums. The technical systems we use also automatically create log files from which conclusions can be drawn about you and your behaviour.

Usage-related information: When you use PitchIn, we collect information about which services you use and how. For example, we see whether you regularly ask questions or answer questions more often.

Information through your contributions: We collect information about your contributions. For example, we see how many questions you have asked and how many users have seen these questions.

Information about your device: Information about your device allows us to see how many people use PitchIn on Android and how many use PitchIn on iOS.

Your device's contact list: To find your friends faster, we may access your contacts on your mobile phone with your permission.

Camera and photos: For example, to be able to set a profile picture in the profile, we need access to the camera or photo album of the user's device.

Location information: With your consent and in order to make the best use of some of PitchIn's settings, we use your location information via GPS or through other methods.

Documents: If you want to share documents with your friends or the public, we need access to your documents.

 

All of this information is used to provide you with our best possible service and to optimise PitchIn.

 

B. Our cooperation with third parties

a) Sharing data to benefit from certain services:

PitchIn relies on the cooperation of other companies. Where necessary for one of our services, these companies will receive and process information about you. We do not share your data without your consent or without a legal basis (see below). Our partner companies are just as obliged as we are to process your data in accordance with data protection regulations.

 

In detail, these are:

  • Hosting services through AWS and WIX.

  • User analyses through Google Analytics

  • Usage of the Snapchat Bitmoji sticker kit through API integration

  • Map service through Mapbox

  • Payment services through Stripe

 

Partner companies in the USA or in other countries outside Switzerland, the EU or the countries of the European Economic Area are subject to data protection laws that may not protect your data as they do in Switzerland or the EU. In these cases, we contractually oblige our partner companies to ensure that your data is adequately protected.

In practice, however, we cannot constantly monitor how these companies handle your data. If we discover gross misconduct, these companies will be warned, or we will terminate our cooperation with them.

 

b) The collection of data by third parties:

We might receive some information about you from users, member organisations or third parties.

 

Here are some examples:

  • If you connect your PitchIn account to other services such as Snapchat or Bitmoji, we might receive information regarding your use of that service.

  • If a user uploads their contact list, we may be able to create links between that contact list and the information we have collected about you.

  • If you have contacted someone through advertising on PitchIn, the advertiser may share some information with us so that we can measure the performance of such advertisements.

 

c) How the Bitmoji is used within PitchIn:

  • PitchIn Bitmoji Kit integration adheres to the Bitmoji Brand Guidelines.

  • PitchIn does not offer core features similar or identical to Bitmoji.

  • The PitchIn app does not use the Bitmoji anywhere in its title nor does it use Bitmoji in any app promotion or Screenshots.

  • The App does not use the Bitmoji or other Bitmoji artwork as generic or stock images.

  • The App does not allow users the ability to share Bitmoji of anyone including themselves.

  • It does not monetize on their Bitmoji directly or indirectly nor is the purpose of the app to create or distribute stickers.

  • The app in no way promotes, distributes or allows users to create Bitmoji stickers.

  • It does not allow the users to modify the Bitmoji artwork.

  • PitchIn is a quality product that does not contain offensive, lewd, or crude material and respects its users and treats them fairly.

  • PitchIn has a publicly accessible privacy policy that completely and accurately describes how we collect, use, disclose, and retain data.

  • PitchIn’s privacy policy does not conflict with or modify Snap Inc.'s privacy policy.

  • Pitchin does not use Bitmoji Kit to create and sell personalized merchandise.

 

How do we integrate with Bitmoji?

  1. Every PitchIn app user can go to their profile screen of the app and select the Add Bitmoji feature.

  2. This routes the user to login with their Snapchat account

  3. If they do not have a Snapchat account then the user would create one.

  4. Once the user has logged into Snapchat, they can select from multiple stickers of the user’s avatar provided by Bitmoji

  5. If they do not have a Bitmoji created then the user would create a Bitmoji and then choose from multiple stickers of the user’s Bitmoji, which get provided by Bitmoji.

  6. The user then exits Snapchat after selecting one particular sticker.

 

Note: A user can change the sticker used as their profile picture by following the same procedure.  The app in no way allows the users to modify/edit/share the sticker outside the app or any third-party applications.

 

 

C. Legal basis

We are obliged to process your data only in accordance with the law. Here you will find the legal basis for this:

 

a) If you have given us express consent to process your data, the legal basis for this processing is Art. 13 para. 1 DSG (Switzerland) or 6 para. 1a) DSGVO.

b) If we process your data in order to carry out pre-contractual measures, the legal basis is Art. 13 para. 2 DSG (Switzerland) or Art. 6 para. 1b) DSGVO.

c) In all other cases, Art. 13 para. 2 DSG (Switzerland) or Art. 6 para. 1f) DSGVO is the legal basis.

 

D. Storage period

Different information is stored for different periods of time. Basic account information such as your name, mobile number and email address will be deleted as soon as you ask us to do so. Questions that you have asked via PitchIn and then deleted will also be deleted by us after the time you have specified for this purpose has expired.

 

We continue to store and process your data while you are actively using PitchIn.

If you have not been active on PitchIn for 2 years, we will delete your data. Of course, we will try to get in contact with you first.

In all cases, we will retain the data required by commercial and tax law for the periods specified by law, i.e. regularly for ten years.

 

E. Your rights as a data subject

By using PitchIn, you are given rights to protect your data so that you always retain control and dominion over your data.

 

a) Right to information

You will receive information from us - after appropriate verification of your identity by means of an official identification document - as to whether or not we are processing personal data relating to you.

If such processing is taking place, you will receive the following information from us in electronic form:

(1) the purposes for which the personal data are processed;

(2) the categories of personal data which will be processed;

(3) the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;

(4) the envisaged duration of the storage of the personal data relating to you or, if it is not possible to provide specific information in this respect, criteria for determining the duration of the storage;

(5) the existence of a right to rectify or erase the personal data concerning you, a right to restrict processing by PitchIn or a right to object to such processing;

(6) any available information about the origin of your data if it has not been provided by you.

(7) You have the right to request information about whether your data is transferred to a third country or to an international organisation.

 

b) Right to rectification

You have the right to have your data corrected and/or completed if it is incorrect or incomplete. We will make the correction as soon as possible. You can also edit some of your data yourself directly via the application in the settings or in your own profile. To do this, simply click on the corresponding field that you want to edit. In case of difficulties, questions or data that cannot be edited directly - write to us.

 

c) Right to restriction of processing

You may request the restriction of the processing of data relating to you under the following circumstances:

(1) if you dispute the accuracy of the data concerning you for a period of time to allow us to verify the accuracy of your data;

(2) if the processing is unlawful and you refuse to erase your data and instead request the restriction of the use of the personal data;

(3) if we no longer need your data for the purpose of processing, but you need it to assert, exercise or defend legal claims,

If the processing of your data has been restricted, these data may - apart from being stored - only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest.

If the restriction of processing has been restricted in accordance with the above conditions, you will be informed by us before the restriction is lifted.

 

d) Right to erasure

a) Obligation to delete

You may request PitchIn to delete your data immediately.

We are also obliged to delete your data if one of the following reasons applies:

(1) Your data is no longer necessary for the purposes for which it was collected or otherwise processed.

(2) You withdraw your consent on which our processing was based or there is no other legal basis for lawful processing.

(3) You object to our processing and we have no overriding legitimate grounds for processing.

(4) If your data is deleted, it will first be made inaccessible to third parties for a certain period of time and then irrevocably deleted.

 

b) Exceptions

The right to erasure does not apply if the processing is necessary:

(1) to exercise the right to freedom of expression and information;

(2) for compliance with a legal obligation to which the processing is subject under the law to which we are subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in us;

(3) for reasons of public interest in the field of public health;

(4) for archiving, scientific or historical research purposes in the public interest or for statistical purposes, where the right referred to in paragraph (a) is likely to make impossible or seriously prejudice the achievement of the purposes of such processing; or

(5) for the establishment, exercise or defence of legal claims.

 

f) Right to information

(1) If you have exercised your right to rectification, erasure or restriction of processing against PitchIn, we are obliged to inform all recipients to whom your data has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort.

(2) You have the right to be informed about these recipients.

 

g) Right to data portability

You have the right to receive your data that you have provided to PitchIn in a structured, and commonly used format. You also have the right to transfer this data to another controller without hindrance from us, provided that:

(1) the processing is based on consent pursuant to Art. 6(1)(a) DSGVO or Art. 9(2)(a) DSGVO or on a contract pursuant to Art. 6(1)(b) DSGVO; and

(2) the processing is carried out with the help of automated procedures.

In exercising this right, you also have the right to have your data transferred directly from us to the third party you have indicated, insofar as this is technically feasible. The freedoms and rights of other persons must not be affected by this.

The right to data portability does not apply to processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

 

h) Right of objection

You have the right to object at any time on grounds relating to your particular situation, to the processing of your data which is carried out on the basis of Article 6(1)(e) or (f) DSGVO; this also applies to profiling based on these provisions.

PitchIn will no longer process your data in the event of an objection, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.

If your data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of your data for the purpose of such marketing; this also applies to profiling insofar as it is related to such direct marketing.

 

i) Right to withdraw your consent under data protection law

You have the right to revoke your previous consent to the processing of your data at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

 

F. Changes to our data protection regulations

The data protection measures are always subject to technical and legal updates. For this reason, we ask you to inform yourself about our data protection measures at regular intervals. The current data protection statement will then apply to your next visit.
